Terms of Service

These Terms of Service ("Terms") govern your use of browser extensions and related products ("Products") published by Browseby, operated by Filipe Monserrate ("we", "us", "our"). By installing or using our Products, you agree to these Terms.

1. Products and Services

Browseby develops and publishes browser extensions for Google Chrome, including Quick Reopen and BrowseNotes. Our Products are available via the Chrome Web Store and our website at https://browseby.app.

Each Product offers a free tier with core functionality and an optional paid upgrade ("Pro") that unlocks additional features.

2. Free Tier

The free tier of our Products is available to everyone without registration, payment, or account creation. We reserve the right to modify free tier features at any time, but we will not retroactively remove functionality that was available at the time of your installation without reasonable notice.

3. Pro License

3.1 Purchase

Pro licenses are sold as one-time payments through our authorized reseller, Lemon Squeezy (Lemon Squeezy, Inc.). Lemon Squeezy acts as the Merchant of Record for all transactions and handles payment processing, invoicing, and VAT compliance.

3.2 License Key

Upon purchase, you will receive a license key via email. This key activates Pro features on your device. Each license allows activation on up to 5 (five) devices simultaneously. You may deactivate a device at any time to free up an activation slot.

3.3 License Duration

Pro licenses are perpetual — there is no expiration date. Once purchased, Pro features are yours to use indefinitely, including all updates to the Pro tier released after your purchase.

3.4 License Restrictions

You may not resell, share, sublicense, or distribute your license key to others. One license is for one person. If we detect systematic abuse (e.g., a single key shared publicly), we reserve the right to revoke the license after notifying you and providing an opportunity to respond.

4. Pricing

All prices are displayed in euros (EUR) and include applicable taxes (VAT) where required. The Merchant of Record (Lemon Squeezy) calculates and collects the correct tax based on your location.

We reserve the right to change pricing for future purchases at any time. Price changes do not affect existing license holders.

5. Refund Policy

We offer a 14-day money-back guarantee on all Pro license purchases, no questions asked.

If you are not satisfied with your purchase for any reason, you may request a full refund within 14 days of the purchase date. To request a refund:

Refunds are processed within 5-10 business days and returned to the original payment method.

After the 14-day period, refunds are granted only in exceptional circumstances at our discretion (e.g., a critical defect that we cannot resolve within a reasonable timeframe).

6. Intellectual Property

All Products, including their code, design, documentation, and branding, are the intellectual property of Filipe Monserrate / Browseby. Your Pro license grants you a personal, non-exclusive, non-transferable right to use the Pro features. It does not grant ownership of any part of the Product.

7. User Data and Privacy

Our Products are designed with privacy as a core principle. We do not collect, transmit, or store your personal browsing data. All extension data is stored locally on your device.

8. Availability and Updates

We strive to keep our Products available and functional, but we do not guarantee uninterrupted availability. Browser updates, Chrome Web Store policy changes, or technical issues may occasionally affect functionality.

We may release updates to our Products at any time. Updates may include bug fixes, new features, or changes required by Chrome Web Store policies. Updates to the free tier are provided at our discretion. Pro license holders receive all updates to Pro features at no additional cost.

9. Disclaimer of Warranties

Our Products are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our Products will be error-free, secure, or compatible with all systems or configurations.

To the maximum extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Browseby shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Products.

Our total liability for any claim arising from these Terms or your use of our Products shall not exceed the amount you paid for your Pro license.

This limitation does not apply to liability that cannot be excluded or limited under applicable law, including the laws of Portugal and the European Union.

11. Termination

You may stop using our Products at any time by uninstalling them. Your Pro license remains valid even if you uninstall and reinstall later.

We may terminate or suspend your access to Pro features if you violate these Terms, specifically the license restrictions in Section 3.4. In such cases, we will notify you and provide an opportunity to respond before taking action.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. For material changes, we will notify you via email (if you are subscribed to our mailing list) or through a notice in the Product.

Continued use of our Products after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Portugal. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal, without prejudice to any mandatory consumer protection provisions of your country of residence that may apply under EU law.
